TERMS AND CONDITIONS OF SUPPLY
1. These terms
1.1 These are the terms and conditions on which we supply products to you.
1.2 Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you and other important information. If you think that there is a mistake in these terms, please contact us to discuss.
2. Information about us and how to contact us
2.1 We are Native Sister and our main place of business is at 6 Beechgrove Place, Aberdeen, AB15 5HF. Native Sister is owned and operated by EMIMAC LTD, a company registered in Scotland under Company Number SC584015 and having its registered office at 6 Beechgrove Place, Aberdeen, AB15 5HF.
2.2 You can contact us by writing to us at email@example.com.
2.3 If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us in your order.
2.4 "Writing" includes emails. When we use the words "writing" or "written" in these terms, this includes emails.
3. Our contract with you
3.1 Our acceptance of your order will take place when we email you to accept it, at which point a contract will come into existence between you and us.
3.2 If we are unable to accept your order, we will inform you of this and will not charge you for the product. This might be because the product is out of stock, because of unexpected limits on our resources which we could not reasonably plan for because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified.
3.3 We will assign an order number to your order and tell you what it is when we accept your order. It will help us if you can tell us the order number whenever you contact us about your order.
4. Our products
4.1 Products may vary slightly from their pictures. The images of the products on our website are for illustrative purposes only. Your product may vary slightly from those images.
4.2 Product packaging may vary. The packaging of the product may vary from that shown in images on our website.
5.1 You must pay for the products at the point of order. Payment will be debited and cleared from your account immediately on order. Payment methods include Debit, Credit cards, Visa, MasterCard, American Express and PayPal.
5.2 You confirm that the credit or debit card that is being used is yours and registered to the billing address. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to Native Sister, Native Sister will not be liable for any delay or non-delivery.
5.3 All prices are inclusive of VAT (where applicable) at the current rates. We will pass on changes in the rate of VAT. The total cost of your order is the price of the products plus delivery charges as set out in the delivery section of these Terms and Conditions of supply.
5.4 Once you have placed an order you will receive an Order Confirmation email as well as an email to let you know when we have dispatched your order.
6.2 All orders are dispatched via a recorded service and will require a signature.
6.3 We are not responsible for delays outside our control. If our supply of the products is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event.
6.4 If no one is available at your address to take delivery and the products cannot be posted through your letterbox, the delivery company will leave you a note informing you of how to rearrange delivery or collect the products from a local depot (if possible).
6.5 If you do not collect the products from us as arranged or if, after a failed delivery to you, you do not re-arrange delivery or collect them from a delivery depot we will contact you for further instructions. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection we may end the contract.
6.6 A product will be your responsibility from the time we deliver the product to the address you gave us or you collect it from us.
7. Returns and Replacements
7.1 All parcels returned to us (from either not being collected, incorrect delivery address or any other valid reason) can be re-sent to you. However, this will require an additional payment from you to cover the cost of second-time delivery.
7.2 If a refund is requested and accepted by us, it will be immediate and will be processed back to your original method of payment minus the cost of the initial post and packaging fee. An e-mail confirmation will be sent once any refund is initiated. Please note that funds can take up to five working days to show up in your account.
7.3 Any faulty items must be returned to us before a replacement is sent out. If the fault is agreed, we will provide a replacement for the returned goods. We reserve the right to refuse refund on any product.
7.4 All of our packages are wrapped with the utmost care and attention to give the product inside maximum protection so we cannot be liable for any damage to the product in transit. However, each case is assessed individually.
7.5 Returns of faulty items will only be accepted if the goods were faulty when delivered to you, we take every effort to check your purchase thoroughly for any faults before sending them out to you. All items returned as faulty will be inspected on receipt and any items deemed subject to fair wear and tear will not be accepted as faulty.
